Repugs Lose 56-44. Impeachment Trial is Constitutional.

 

The good news is that the Dems carried the day on the challenge to the constitutionality of impeaching a president after he has left office. 

The bad news is that it was a 56-44 vote. That will likely hold up on the vote of whether to convict or acquit which will be well short of the two-thirds majority needed to convict.

There are two grounds of impeachment: Trump inciting the mob to assault the Capitol and Trump previously trying to cajole Georgia state officials to "find" an extra 11,700 Republican votes to deliver the state from Biden to Trump. The tape of that conversation does have Trump threatening the Georgia secretary of state should he refuse.

Trump's legal counsel are performing as expected. They're screw ups. David Schoen tried to intimidate the assembled senators by warning the trial could spark another civil war. "This trial will tear this country apart, perhaps like we have only seen once before in American history." Schoen's team mate, Bruce Castor went one further by suggesting that, rather than impeachment, the Department of Justice ought to arrest his client on felony charges. “A high crime is a felony, and a misdemeanor is a misdemeanor. After he’s out of office, you go and arrest him. ... The department of justice does know what to do with such people. And so far, I haven’t seen any activity in that direction.”

Meanwhile Trump buddy, Alan Dershowitz, took to NewsMax to deliver a scathing critique of Trump's lawyers.  “There is no argument. I have no idea what he is doing. I have no idea why he’s saying what he’s saying.”

Why Trump has the votes to win the trial proper he's probably fuming at his legal representation.

Bruce Castor closed his opening comments by acknowledging that Donald Trump’s defense team was caught off guard by the strength of the House impeachment managers’ presentation.

  2. Trump is a fool. He has had the best lawyers at his disposal but he refuses to accept their advice and he stiffs them on their fees. No lawyer is going to trash his own reputation by pulling stunts for a foolish client. It won't work and it will only make counsel look incompetent. Reputations are easily lost and can be nearly impossible to repair.

  3. Remember - while it has characteristics of a legal situation, impeachment (as we've painfully learned before) is a political process.

    With a guaranteed acquittal in sight, and with FOX and other phony thought leaders successfully creating an alternate narrative for the half the population to cling to, why does tRump need "the best lawyers"? All he needs (as usual) is a few charlatans to clown it up for the base.

    1. The Dems may be targeting the GOP as much as Trump, NPoV. They put up a blistering presentation on Days One and Two, leaving Team Trump to do the Giuliani Grope. It won't move many of the Gullibillies, Trump's true believers, but it will deepen the rift within the Republican ranks and the public at large are said to be moving toward the blue albeit at a glacial pace. This probably will have some impact on the mid-terms. I'm sure the Dems will be getting extended play out of those videos.
